Borrowing $200–$5,000 in New York
New York has some of the strictest small-loan rules in the country. Payday lending is illegal, check cashers are barred from making loans, and a non-bank lender that charges more than 16% without a license commits civil usury; above 25% it is a felony. The Department of Financial Services actively pursues online and tribal lenders that try to lend to New Yorkers at higher rates.
The practical effect for a $200–$5,000 borrower is that the maximum APR you should ever see from a licensed lender is 25%. Several national online lenders either cap New York offers at 24.99% or do not lend in the state, so approvals for fair credit are harder to get here, but the ones you do get are cheaper. Credit unions (18% cap) and New York's community development credit unions are the deepest source of small loans.
The national picture for context: the average bank personal loan rate was 11.90% in August 2026 (Federal Reserve G.19), credit cards averaged 22.36%, and federal credit unions are capped at 18% everywhere. State law matters most at the small end, where it decides whether a $500 loan costs $8 or $75 for a month.

State law governs non-bank lenders. Banks and federal credit unions follow federal rules, which is why a bank credit card can exceed a state cap while a state-licensed lender cannot. Laws change; the "verified" date above is when we last checked the statutes and regulator guidance cited in the sources.

The order rarely changes: a credit union first, a national online lender or licensed installment lender second, and the payday product, where New York allows one, a distant last. For $2,000–$5,000 the comparison is mostly between online lenders and credit unions; use the payment calculator with the APR from a pre-qualified offer.

New York personal loan questions
Are payday loans legal in New York?
No. New York's usury laws cap non-bank lenders at 16% (civil) and 25% (criminal), which makes a payday loan impossible to offer legally. DFS has shut down online and tribal lenders targeting New Yorkers, and loans above 25% are void. Any "New York payday loan" offer is either illegal or a scam.
What is the highest legal interest rate on a personal loan in New York?
25% APR for lenders licensed by DFS under Banking Law Article 9 on loans of $25,000 or less. National banks can export their home-state rates, which is why some bank credit cards exceed 25%, but personal-loan lenders in New York overwhelmingly price at or below 24.99%.
Why was I declined by an online lender in New York when my friend in Texas was approved?
Because the lender cannot charge more than 25% in New York. Borrowers whose risk would be priced at 28%–36% elsewhere are simply declined here. A credit union, a co-signer or a secured loan are the usual routes for fair credit in New York.
